DAX Creative Hub LLC · Legal
Terms &
Conditions.
Clear terms for the Mobiletiser™, Mobiletising™ services, and doing business with DAX Creative Hub LLC.
Mobiletiser units are specialized vehicle-mounted equipment. Model availability, final specifications, professional installation requirements, shipping or pickup arrangements, and any production deposit should be confirmed in your written order before payment. Your rights under applicable law are not waived by these Terms.
Acceptance of Terms
These Terms & Conditions (“Terms”) govern access to daxcreativehub.com, requests for quotations, purchases of Mobiletiser™ products and related accessories, and Mobiletising™ advertising or design services supplied by DAX Creative Hub LLC (“DAX,” “we,” “us,” or “our”).
By using the website or entering into an order or service agreement that expressly incorporates these Terms, you agree to their applicable provisions. For purchases, material terms—including product details, total charges, expected fulfillment timing and cancellation terms—will be disclosed before you agree to pay. If a signed quotation, invoice, or separate written agreement expressly conflicts with these Terms, the more specific document controls for that transaction, subject to applicable law.
Nothing in these Terms limits rights or remedies that cannot lawfully be excluded.
Company & Products
DAX Creative Hub LLC is a Texas-based business developing and offering the Mobiletiser™, a removable, vehicle-mounted advertising device. Mobiletising™ refers to the related mobile advertising concept and services.
Available or planned configurations may include Base, Plus and Premium, digital advertising displays, non-digital side panels, supplemental power components, GPS equipment, accessories, printed wraps and campaign creative. Some models and options may be prototypes, in development, limited in availability, or subject to verification before sale.
Images, renderings, demonstration videos and prototypes are illustrative. The purchased unit's agreed specifications will be documented in the accepted order. We will not substitute a materially different product without communicating the change and obtaining any consent required by law.
Eligibility & Accurate Information
Customers placing orders must be at least 18 years old and legally able to enter into a contract. If purchasing for a business, you represent that you are authorized to bind that business. You agree to provide accurate contact, shipping, billing, vehicle compatibility and design information and to update us promptly if relevant details change.
We may decline an inquiry or unaccepted order for legitimate business, safety, fraud-prevention or legal reasons, subject to applicable nondiscrimination and consumer-protection laws.
Pricing, Quotations & Orders
Prices shown on the website are in U.S. dollars unless stated otherwise. Applicable taxes, delivery, freight, professional vehicle installation, custom artwork, upgrades and other optional charges may be additional and will be disclosed before the customer authorizes payment.
Website listings and preliminary quotes do not guarantee inventory, compatibility or production acceptance. An order becomes binding when DAX confirms it in writing and the customer accepts any applicable final specifications and payment terms. If payment is received for an order DAX cannot accept, we will promptly arrange the appropriate refund.
We may correct typographical or obvious pricing errors before accepting an order. We will seek customer consent before making a material price change to an already accepted order, except for changes the customer separately requests and approves.
Custom Builds, Reservations & Deposits
Mobiletisers may be manufactured to order. DAX may request confirmation of model, finish, electrical configuration, side-display selection, artwork, vehicle details and agreed installation plan before beginning production.
Any reservation or production deposit must be separately identified at checkout or in a written order agreement, including its amount, how it applies to the total purchase price, when production starts, and its cancellation/refund treatment. Submitting an inquiry alone does not reserve inventory or obligate you to pay.
Changes requested after production begins may affect price, specifications and schedule. DAX will provide a revised quote or written change order for customer approval before charging for material changes.
Production Times, Delivery Estimates & Delays
Production periods displayed on the site are estimates unless a specific commitment is confirmed in writing. The expected shipment or pickup date for each accepted order will be identified during order confirmation. Production schedules may be affected by component availability, customization, engineering verification, inspection and other legitimate factors.
If we cannot meet a promised shipment deadline, we will provide any legally required delay notice and offer the customer the opportunity to agree to the revised schedule or cancel and receive the refund required by applicable law. We will not treat these Terms as advance consent to indefinite delays.
If DAX determines that it cannot fulfill an order, it will notify the customer and provide the refund required by law. Transit times after shipment may vary by carrier and destination.
Important: An estimated manufacturing period does not replace the customer's statutory rights concerning delayed online merchandise orders.
Third-Party Financing
DAX may offer access to independent financing or equipment-leasing providers for qualified customers. Financing is subject to the lender's approval, disclosures, eligibility requirements and separate agreement. DAX does not promise that a customer will qualify or that a particular interest rate, term or monthly payment will be available.
Unless expressly stated otherwise in a separate agreement, DAX is the equipment seller, not the lender. Loan payments, financing charges, late fees, credit decisions and repayment obligations are governed by the financing provider's contract. DAX will disclose any applicable merchant-side conditions that affect the customer's purchase before the transaction is finalized.
Financing approval alone does not guarantee that production has begun or that DAX has received funding. Cancellations or refunds involving a financed order will be coordinated as required by the lender's process and applicable law; the customer's loan obligations are not automatically terminated merely by contacting DAX.
Pickup, Shipping, Delivery & Damage
Pickup, local delivery or freight shipping options are determined by product dimensions, destination and the accepted order. Packaging, shipping, insurance and installation charges are stated before payment. The order confirmation will identify the agreed delivery method.
Customers should inspect the package and device promptly on receipt. If damage or missing components are discovered, please preserve packaging, take photographs and contact DAX promptly—preferably within five business days—so we can assist with carrier claims and corrective steps. This preferred reporting period does not eliminate any warranty or statutory rights.
Responsibility for loss or damage during shipment will be governed by applicable law and the parties' agreed shipping terms. DAX will not use a carrier's delivery scan alone to deny a valid legal claim.
Professional Installation & Removable Design
Professional electrical installation requiredEach Mobiletiser is designed as a removable device with mounting straps and an auxiliary brake-light/turn-signal wiring connection that may use a quick-detach connector. Initial integration of the vehicle-side brake-light and turn-signal wiring must be performed by a qualified automotive professional. Professional installation, fitment assessment and labor are not included in the equipment price unless explicitly listed in the order.
The quick-detach feature is intended to simplify later device removal and reconnection after proper initial installation; it does not eliminate the need for secure mounting, approved wiring, electrical checks or inspection before driving. Vehicle-side connections should remain safely protected when the device is detached.
Supplemental lighting is not a substitute for functioning factory brake lights, turn signals or other legally required equipment. The device must not obscure the driver's view, registration plates, factory lighting, emergency signals or other safety-related vehicle features.
Vehicle compatibility must be assessed before installation, including roof load capacity, fastening points, clearance, electrical capacity and local rules. Do not use the device if mounting is loose, wiring is damaged, or operation may be unsafe. Installation and use remain subject to all nonwaivable product-safety laws.
Product Use, Advertising & Legal Compliance
Rules governing vehicle-mounted displays, moving or illuminated advertisements, brightness, flashing content, sign placement, vehicle modifications and roadway operation vary by location. DAX does not represent that every configuration is legal for every vehicle, road, city or state.
The customer and any operator are responsible for verifying applicable registration, permitting, insurance, vehicle equipment and advertising restrictions before operating the unit. Never use the device in a manner that distracts drivers, imitates emergency-vehicle signals, interferes with required lighting, or violates laws or regulations.
DAX remains responsible for its own obligations under applicable laws; nothing in this section shifts responsibility for product defects or unlawful conduct where such responsibility cannot legally be transferred.
Display, Charging, GPS & Services
Display brightness, run time, power usage, connectivity and device performance can vary with installation, battery condition, temperature, weather, driving conditions, display settings and other factors. Specifications provided in the accepted order control over informal estimates.
Where included, solar panels and wind turbines provide supplemental charging. They are not guaranteed to make a unit energy-independent or to maintain continuous operation without other charging sources. GPS tracking and connected features may depend on network coverage, third-party platforms or separate service terms; any recurring fees must be disclosed and separately authorized before purchase.
Optional wraps, creative packages, software, installation, future upgrades or other services will be detailed in the accepted quote, service description or separate agreement. DAX does not guarantee advertising impressions, leads, sales, revenue or return on investment.
One-Year Limited Warranty
One-year limited warrantyWarrantor: DAX Creative Hub LLC, Pearland, Texas 77584. To request a free written copy or to initiate a claim, email create@daxcreativehub.com or call 346-885-5896.
Coverage & duration
For one (1) year from the date the original customer receives the Mobiletiser, DAX warrants that the DAX-manufactured device will be free from defects in materials and workmanship under normal, intended use and when installed and maintained according to supplied instructions. This limited warranty applies to the original purchaser and the Mobiletiser equipment identified on the sales receipt.
How to make a claim
Contact DAX with the order number, proof of purchase, device identification (if provided), a description of the issue and relevant photographs or video. DAX will provide troubleshooting and return or inspection instructions. Do not ship equipment without receiving instructions. If the claim qualifies, DAX will, within a reasonable time and as permitted by applicable law, repair the defective component, replace it with an equivalent component or device, or refund the appropriate purchase amount.
What is not covered
- Accidental damage, collision, theft, vandalism, cosmetic wear, ordinary deterioration or damage caused by improper storage.
- Damage attributable to improper mounting, unsafe wiring, incorrect electrical supply, misuse, overloading or failure to follow documented operating instructions.
- Damage caused by natural disasters, extreme weather exposure beyond stated product specifications or other external events.
- Third-party vehicles, batteries, mobile networks, artwork, consumables or accessories not expressly included in DAX's written warranty.
Using an independent repair service or third-party part does not automatically void this warranty. DAX may decline coverage for damage that was actually caused by an improper repair, incompatible component or modification, subject to applicable law.
Service costs & legal rights
For an approved warranty repair, DAX covers the qualifying repair or replacement parts and labor, and standard return shipment within the contiguous United States. Unless applicable law requires otherwise or DAX agrees otherwise in writing, the customer is responsible for safely removing the device, shipping it to DAX after receiving instructions, and any vehicle reinstallation expense. No charge will be imposed for covered parts and repair labor.
This warranty gives you specific legal rights, and you may also have other rights that vary from state to state. DAX does not disclaim implied warranties where prohibited by law. Any lawful limit on the duration of implied warranties shall not be shorter than the express one-year warranty period and shall apply only where permitted.
Before purchasing: Customers may request the complete written warranty by email or phone. DAX will make the applicable warranty available for review before sale.
Cancellations, Returns & Refunds
Before DAX accepts an order: You may withdraw your inquiry or proposed order without a production charge. Any payment collected for an unaccepted order will be refunded promptly.
Before custom manufacturing starts: Contact DAX promptly to request cancellation. Any refund, including treatment of a reservation or deposit, will follow the terms clearly disclosed and accepted at checkout or in the written order, as well as applicable law.
After custom manufacturing begins: For voluntary cancellations not otherwise protected by law, DAX may account for reasonable, documented and nonrecoverable custom materials or work already authorized, but only to the extent permitted by the signed order terms and applicable law. DAX will explain any lawful deduction before processing a remaining refund.
After delivery: Because units may be built or customized to order, changes of mind or incompatibility arising from inaccurate customer-provided information do not automatically entitle the purchaser to a return. DAX may authorize returns case by case. Defective, misdescribed, incorrectly supplied or legally cancellable orders remain subject to the one-year limited warranty and all applicable statutory rights.
Missed delivery deadlines: When applicable law entitles a customer to cancel due to a shipping delay, DAX will honor that right and provide the legally required refund without imposing a conflicting custom-order penalty.
Refunds are generally issued to the original payment method, or otherwise as required by law. Financed transactions may require coordination with the financing provider. Shipping and custom-work charges, where refundable or nonrefundable, must be clearly disclosed before the order is placed.
Advertising Services & Customer Artwork
Customers who provide logos, images, advertising copy, brand names, videos or other materials represent that they have the rights and permissions necessary for the requested use. Customers grant DAX a limited, nonexclusive license to reproduce and adapt those materials solely as reasonably necessary to complete the ordered goods or services.
Customers are responsible for substantiating factual claims in their advertising and securing permissions for third-party intellectual property, publicity rights and regulated-product promotions. DAX may request changes to or refuse unlawful, misleading, infringing or unsafe creative content.
For DAX-created ad campaigns and wrap design, the project quote will state deliverables, revisions, artwork specifications, schedule, license rights and any ongoing fees. Media placement, audience exposure, impressions, leads and sales are not guaranteed unless explicitly stated in a signed agreement.
Intellectual Property
Names, logos, product designs, text, photography, videos, website design and other original DAX materials are owned by DAX or used under license, subject to applicable intellectual-property law. Mobiletiser™ and Mobiletising™ are used as DAX product and service identifiers; use of the ™ symbol is not a representation that federal registration has been issued.
Buying a Mobiletiser transfers ownership of the purchased physical unit as provided by the sales agreement, not DAX's patents, trademarks, copyrights, source code, engineering drawings or other intellectual property. Customer-supplied artwork remains the customer's or licensor's property. Rights to finished custom design deliverables are governed by the accepted project agreement and applicable third-party licenses.
Website Availability & Privacy
We aim to keep our website and online information accurate and available but cannot promise uninterrupted service or error-free display on every device. You agree not to disrupt the site, misuse inquiry forms, attempt unauthorized access or upload malicious code.
Personal information collected through the website, checkout, contact forms or customer communications is handled as described in our Privacy Policy. Independent payment processors, financial providers and third-party software services may have their own notices and contractual terms.
Marketing texts or emails will be sent only as permitted by applicable law and any consent given. Purchasing a device does not require consent to unrelated promotional messages.
Disclaimers & Limitation of Liability
Except for express warranties and rights that cannot lawfully be waived, DAX makes no promise concerning uninterrupted advertising performance, geographic legality of every customer installation, a particular number of viewers, marketing results or commercial earnings.
To the maximum extent permitted by applicable law, DAX is not liable for indirect, incidental, special or consequential commercial losses, including lost revenue, lost profits or business interruption arising from the website, advertising services or equipment. Where legally permissible, DAX's aggregate contractual liability for a particular order will not exceed the amount paid to DAX for that order.
These limitations do not apply to the extent prohibited by law, including liability that cannot be excluded for personal injury, product defects, fraud, intentional misconduct, gross negligence or nonwaivable warranty and consumer-protection remedies. Some jurisdictions do not permit certain exclusions, so portions of this section may not apply to you.
Resolution & Governing Law
If a problem arises, we encourage you to contact DAX first so we can investigate and seek a practical resolution. Nothing in these Terms prevents you from contacting a regulator, exercising chargeback rights where applicable, or pursuing legal rights that cannot be waived.
Except where mandatory law requires otherwise, these Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles. Disputes may be brought in a court with appropriate jurisdiction, subject to mandatory consumer forum and venue protections. These Terms do not impose mandatory arbitration or waive the right to a jury trial.
Changes, Severability & Entire Agreement
DAX may update these website Terms from time to time and will post an updated effective date. Changes apply prospectively and will not retroactively alter an accepted order without any consent legally required.
If a provision is held unenforceable, the remaining provisions continue to operate to the extent lawful. Failure to enforce a term on one occasion does not waive the right to enforce it later. These Terms, the accepted order and any expressly incorporated written agreement describe the applicable transaction terms, subject to nonwaivable laws.
